Rescind expanded BDR, closed-school discharge, and PSLF regulations

Mandate demands negotiated rulemaking to rescind July 2023-effective borrower-defense, closed-school, and PSLF expansions and arbitration/class-waiver bans, citing unauthorized cost to taxpayers, plus rescinding related accreditation Dear Colleague letters.

Mandate

Mandate Ch. 11 (Education) — Student Assistance Final Regulations: quickly commence negotiated rulemaking to rescind BDR/CSLD/PSLF expansion regulations and arbitration/class-action waiver prohibitions; also rescind DCL GEN 22-11, GEN 22-10, and July 19, 2022 accreditation letters undercutting Florida SB 7044.

Undo plan

1) Keep strong borrower-defense remedies for proven fraud while restoring due process for schools. 2) Maintain PSLF for qualifying public-service borrowers with integrity controls. 3) Revisit arbitration rules to preserve student class remedies against predatory schools. 4) Support institutional accreditation flexibility without eliminating quality gates. 5) Verify: discharge volumes, fraud findings, and budget cost estimates.
